01Who provides the service

KOMUNICATOR is provided by Consorzio Intermedia (Consorzio Intermedia, Via Prealpi 8, 20833 Giussano (MB), VAT 14785740961), “we” below. These terms apply to the komunicator.com website, the KOMUNICATOR apps, the web app and the admin portal.

02The service

KOMUNICATOR is a subscription business communication platform: messages and groups, voice and video calls, meetings with minutes, an interpreter, an AI assistant, calls to outside numbers, guests and an admin portal. The features available depend on the plan chosen and on those the administrator turns on.

03Who it is for

The service is sold only to companies, organisations and professionals acting for purposes related to their business (the “Customer”). It is not offered to consumers.

The people who use the apps (the “Users”) do so with an account created by the Customer. By using the app, Users accept these terms as far as they concern them, and the usage rules the Customer gives them. The service is not intended for anyone under 16.

04Activation and accounts

The Customer activates the service by giving the company name, an address and a contact email, and appoints one or more administrators. Administrators create and suspend Users' accounts and choose the environment's features, providers and settings.

The Customer is responsible for the people it gives an account to, for the information it gives them about data processing (including the administrator's ability to recover history and detect screenshots) and for the actions of its administrators. Each User keeps their credentials safe and tells us, through their administrator, about unauthorised access.

05Subscription, payments and cancellation

The subscription is monthly or yearly, per person or as a package, at the prices published on the Pricing page or agreed in writing. It renews automatically when it expires. Payments are handled by Stripe.

Moving to a higher plan takes effect immediately, with the difference charged for the remaining period; moving to a lower plan takes effect from the next renewal. The Customer can cancel at any time from the portal: cancellation takes effect at the end of the period already paid and gives no right to a refund for the current period, unless agreed otherwise in writing.

06Third-party services chosen by the Customer

Some features use providers that the Customer chooses and connects with its own keys or contracts: artificial intelligence (OpenAI, Anthropic, OpenRouter, ElevenLabs), a VoIP phone operator, Flightradar24, its own mailbox. These providers' costs and terms are borne by the Customer and governed by its contracts with them. We are not liable for their outages or changes, but we tell you when a feature is unavailable for this reason.

07Acceptable use

The Customer and Users agree not to use KOMUNICATOR to:

  • break the law or infringe others' rights, privacy or intellectual property;
  • send unsolicited commercial communications or automated calls in breach of telemarketing rules;
  • have the assistant phone people without a lawful reason, or have it introduce itself deceptively;
  • harass, threaten or discriminate;
  • distribute malicious software or try to access environments, accounts or data that are not theirs;
  • overload, probe or bypass the service's security measures;
  • resell the service without a written agreement with us.

In case of breach we may suspend the accounts involved, informing the Customer, to the extent needed to stop it.

08Artificial intelligence can be wrong

The assistant, the interpreter, transcriptions, translations, summaries, minutes and flight information are produced by automated systems that may be incomplete or wrong. They do not replace a person's judgement or professional advice. Check what matters before using it for important decisions.

The assistant acts at your request: it can send messages and emails, make phone calls, create groups and appointments. The User and the Customer remain responsible for the actions the assistant takes on their behalf.

09Emergency calls

KOMUNICATOR is not a replacement phone service and does not guarantee calls to emergency numbers. For emergencies use your phone’s regular line.

10Content and ownership

Content exchanged through KOMUNICATOR belongs to the Customer and its Users. They grant us only the right to store, transmit and process it as far as needed to provide the service. We cannot read end-to-end encrypted content.

The software, the KOMUNICATOR brand and the website materials belong to us or our licensors. The Customer receives a non-exclusive, non-transferable right of use for the duration of the subscription.

11Data protection

For Users' data the Customer is the controller and we are a processor, under the data processing agreement that is part of the contract. How we process data is described in the Privacy policy.

12Availability and support

We strive to keep the service available and secure and to back up each environment every 48 hours. The service may be interrupted for maintenance, which we announce when possible, or for causes beyond our control (network, providers, force majeure). Guaranteed service levels apply only if agreed in writing.

We may improve and change features. If we remove an essential feature of the paid plan, the Customer may withdraw and receives a refund of the unused part of the subscription.

13Suspension, termination and exit

We may suspend the service for non-payment, after a reminder that went unanswered, or for serious breaches of these terms.

On termination access is closed, the administrator can download a readable archive of the history and after 30 days the environment and its backups are permanently destroyed.

14Limitation of liability

To the extent permitted by law, and except in cases of wilful misconduct or gross negligence, we are not liable for indirect damage, loss of profit, data or opportunity, and our total liability to the Customer does not exceed what it paid in the 12 months before the event that caused it.

The Customer indemnifies us against third-party claims arising from content or uses of the service by it or its Users that breach these terms.

15Changes to the terms

We may update these terms. Substantial changes are communicated to administrators at least 30 days before they take effect; if the Customer does not accept them it may cancel before that date.

16Governing law and jurisdiction

These terms are governed by Italian law. The courts of Monza have exclusive jurisdiction over any dispute.
